Lawyers Must Know Technology

As we head into 2017 you must acknowledge technology is not an option in your law practice. It is also not optional that you know technology as a practicing lawyer. Think about it for a minute... How can you create an effective discovery plan in your divorces cases if you don't know about online banking and online finance programs like Quickbooks? How can you effectively adjudicate all the issues n your case if you don't know how to find all the facts? How can you cost effectively deliver legal services if you are not computer savvy? How are you going to communicate with your clients if you don't use email?

If you think you don't need to know technology, then you don't know about practicing law. nowadays. Technology wisdom is no longer on the horizon. It is under our feet, on our desks, in our heads. It has been here since yesterday, and you need to embrace it and know it now!

If you don't believe me, then pay attention to the state bars. They are compelling you to know technology. The State Bar of Florida has amended its CLE rules so that they now require three hours per cycle of technology training. Given how pervasive tech it is in our world, it is only a matter of time before all state bars with have similar rules.

Also pay attention to your malpractice carriers. Those risk management brochures they send you are now filled with warnings compelling us to learn about and implement technology. Malpractice applications now include technology questions.

In your divorce practice do you request data from the opposing parties computer? Are you researching social media use by the opposing party? Do your requests for job search logs include data from job websites? No. Why not? Here is my suggestion for your list of 2017 resolutions:  Start thinking about, using, and investigating technology in your practice. It is not just about word processing anymore...

Which Social Media Platforms Are Important For Lawyers?

I sat down with my 18 year old daughter this weekend to discuss social media.  The options left me dizzy: Instagram, Snapchat, Facebook, YouTube, Twitter, Pinterest, Tumblr, the list goes on and on. Those are just the ones that are hot for teenagers and twenty-somethings.  I decided to investigate further.

I installed the Instagram app on my iPhone, created an account, and within two minutes I had four followers!  Pretty impressive. I went deeper and learned that the function of the app is to communicate with others by posting photos. I posted a photo of my dog. I got no responses, replies, whatever? I decided posting photos of my dog was not a productive means of marketing my family law practice. I deleted the app from my phone.

My experiment begged the question: which social media options are relevant to me and the marketing of my law practice?  The consensus among law firm marketing experts is that LinkedIn is the best.  Attorneyatwork.com asked the experts at the Legal Marketing Association. Each of the three experts said that LinkedIn wins. Facebook was also popular. So too was SlideShare, a service that allows you to uploads presentations, PowerPoints, etc., for the world to view. I had another question.  Before we get to which social media platform is best, I must ask if socia media works at all as an effective tool for marketing a law practice. The experts seem to think so.  I am not so sure, but because there is a chance it might work, I am going to do it.

Create A Facebook Page For Your Law Firm

We all know that Facebook started as a place for people to create personal pages so that they could share information about themselves. It has become so much more than that.  Facebook is now also essential for corporate marketing. For us lawyers that means going beyond a page about you, and onward to a Facebook page for your law firm.

I have confessed many times that I am not a Facebook expert. Fortunately there are other folks who are. Case in point, my trusted advisers at Social Media Examiner. The SME blog is an invaluable resource when if comes to social media (and a lot of other stuff). I love it! I check it weekly, and always come away with some new lesson or trick to help me with the social media marketing of my law practice and my law firm.
Social Media Examiner has published another gold nugget, entitled How To Set Up A Facebook Page For Business. This articles gives you all the 411 to go beyond a personal mugshot page, and start creating some real online visibility for your law office. There's audio, there's text, there's pictures. The article couldn't make it any easier unless they were doing it for you (which they practically are).

For some folks (Me, me, me....) the technology behind Facebook can be very challenging.  The folks at Social Media Examiner get that.  This article is an example of the step-by-step help you can expect.  It also interacts with Facebook's own help screen, that are really becoming more user friendly.  With time my Facebook angst is starting to come down.  Yours will too.

Paid Content Distribution - You Call it Blogging, I Call it a Spammy Waste of Time.

I was at a CLE conference recently, standing in the hallway talking to some colleagues.  One of those folks flatteringly commented on my blogging, and asked me how I do it? I responded as I always do:  I do it very easily.  It's fun, and it only takes a few minutes per day. Her response was a firm No Way. I found a company that will write the posts for me, and it only costs $40 per post.

What she was talking about was a ghostwriter, or in modern day social media parlance paid content distribution.  PCD is not a new idea, but is it a good idea?  Remember how the conversation started?  My friend commended me on my blogging!  She knew me, in part, because of the blog posts that I write! That's important.  Hell's bells, that's why you blog, to draw attention to yourself.  People appreciate my blogs because they know that I write the content.

PCD is not personal. It tells the reader nothing about the writer.  Sure the posts take up bandwidth on the internet, but that's all they do.  Readers can detect canned content.  There is so much PCD these days that I would offer it is not worth the cost. The internet is now overrun with blogs -- and that includes lawyer blogs. PDC just adds to the dilution of blogging efficacy.  LinkedIn, Facebook, and Google are all re-writing their algorithms and filters to block commercial, PCD, advertisements.  If the site filters don't catch the canned content, site/group administrators will.

I know because I am a LinkedIn group moderator and I send PCD posts to the dumpster every day. After all, all a $40 paid blog post is is Spam. Let me give you an example.  You pay a PCD company to write posts for you relating to New Jersey family law.  They write the posts and then post them to every LinkedIn group that you are a member of. I am the moderator of the AAML group on LinkedIn.  An article with the title New Jersey Women With Cheating Husbands Need to Visit My Website To Protect Themselves hits my moderation queue. Appreciating that I am acting as the gatekeeper for a national group, and figuring out in a nanosecond that the post is a blatant solicitation rather than actual information that an AAML member can actually use, I send the post straight to the spam folder (if LinkedIn has not already done that for me). What have you gotten for your $40?  Not much except for an irritated group moderator who does not appreciate having to take the time to insulate other group members from your annoying advertisements; and a report to LinkedIn that you are a spammer so that it can start blocking all of your posts to all of your groups.

I have said this before, and I will say it again:  If you want social media to work, you have to work at it. Is PCD working at it?  No. It is a good way to get rid of your extra cash though...

Facebook Gaining Power. Will Soon Dominate The World.

I post to Facebook.  I do it because I am told I must do it as part of a social media marketing plan. I also take to it to gather evidence to assist me in representing my clients in their divorces. I must confess though I don't get Facebook?  I have no interest in telling burglars that I am on vacation in Europe. I don't appreciate other people splashing photos on the internet of me enjoying my private life.  I don't need to know that someone really loved the bagel that they had for breakfast. The stuff people put out there, and the success I have realized using it against them in court is stunning!

Apparently I am alone in my need to keep my bizness my own. Facebook is gaining strength and taking control of the internet in ways that are hard to fathom.  In fact market reports just this week indicate that while other social media sites like LinkedIn are losing steam, Facebook is on a dramatic uptick.

An article by Adrienne La France in The Atlantic supports the fact that Facebook has you, and you, and you hooked tighter than a size 1 corset on Kate Upton.

Consider these facts (thank you Kevin O'Keefe for culling the article down):

  • Roughly half of the adults who use the Internet report getting their news from Facebook alone.
  • Media companies are already hugely dependent on Facebook for traffic. Vox, for instance, gets 40 percent of visits through the site. Other leading news organizations get something like a quarter of site visits from Facebook.
  • Facebook more than doubled digital ad revenue over the course of two years. The $5 billion in ad money Facebook made last year represents 10 percent of all digital ad revenue.
  • The average American smartphone owner spends more than 42 minutes a day on Facebook. Facebook accounts for one out of every five minutes spent on a smartphone.
  • Facebook has succeeded in thriving financially on mobile while leaving desktop behind. Facebook is getting a quarter of all display ad revenue and more than a third (37 percent) of display ads on mobile. Facebook’s share of revenue on desktop dropped 20 percentage points last year, while its share of mobile revenue went up 20 percentage points.

Those are some stunning statististics! The message is clear, if you want to succeed with internet advertising, you have got to be on Facebook!  Ughh.....

The Value of Social Media

Besides being fun for me, this blog has a very definite business purpose. It is a marketing tool intended to advertise my family law practice. It is a social media tool. Now I can give you more first hand proof that social media channels, including blogs like this, work.

My friend (and often quoted practice management expert) Lee Rosen is huge into social media. Just for twitter he has more than 17,000 followers. A couple of days ago he mentioned this Family Law Lawyer Tech & Practice blog in a twitter post he sent out. Here is Lee's tweet:
Does not look like much, does it? But boy did it work! With one click of his mouse Lee advertised this blog to more than 17,000 people! Then, BOOM, 120 people clicked on the tweet and visited this blog.  That's 120 strangers learning about me. That is great traffic! It has continued for two days now, and more than 200 people have clicked through.  Just as exciting, a high percentage of those visitors then clicked through to the website for Harding & Associates Family Law! That's the magic of social media folks.  I didn't even do anything and I got to introduce myself and my law practice to hundreds of new people. People who can hire me, people who can refer to me, people who can think about me.

Evernote & Biz Cards From Your Hand To Your Contact Manager

Business cards are still a great marketing tool.  They are not virtual, they are tangible.  You can touch them, feel them, smell them.  They work to market you and your practice, and they work to expand your networks.  Handing them out is still an essential element of professional practice marketing.  Collecting business cards is still an essential element in developing your business network. 

Whether you use Microsoft’s Outlook, or Salesforce, or Apple Contacts, or AbacusLaw, or Amicus Attorney, or Goldmine, etc., you need to get those biz card buddies, and their biz card information into your computerized contacts directory.  In days gone by that meant typing the information, line by line, into your computer.  Now you can implement better technology to streamline the process of handling those business cards that you are collecting.

If you use Evernoteand you should — you need to be aware of its awesome business card tools.  With the Evernote app on your smartphone you can take a picture of a business card, have it immediately imported into your Evernote account, export it to your contacts on your phone, and then synchronize it with your Outlook directory or any other contact management program that you use.  Fear not, reading these steps is more complicated than doing the real thing.  For some of these client management programs — Salesforce for example — it is even easier because they have a dedicated Evernote interface.

Even if you have to do it the multi-step way without a dedicated interface, it is still incredibly easy.  Keep reading to learn how. . .  Make sure you read all the way to the end for a bonus tip!

Step One:
Install Evernote on your smartphone.

Step Two:
Lay a business card down on a flat surface.

Step Three:
Launch Evernote on your smartphone, click on the Camera icon, then select the Business Card option.

Step Four:
Move your camera over the business card until Evernote detects it and then automatically takes the picture for you. 

Step Five:
Evernote then reads the business card and imports all of the information as a new contact in your Evernote account.  Nothing for you to do but watch. 

Step Six:
Tell Evernote to send the information to the Contacts app on your phone.  Evernote completes the task immediately, and that biz card buddy’s information is now in your system.

Step Seven:
Synchronize you phone contacts with whatever other Contact program(s) you use.  Nothing could be easier.

Step Eight:
Sit back and enjoy your techie awesomeness!

If you have a LinkedIn account — again you should — Evernote has a one-click feature so that you can connect on LinkedIn with your new business card buddy.


After you have finished importing the business card and saving it in Evernote, Evernote will launch a pop-up window with a one-click LinkedIn button.  If your new biz card buddy has a LinkedIn account Evernote finds that account and then sends a LinkedIn connection request to that person.  How great is that!  This is an example of how software makers are getting away from the old proprietary, keep-em-to-ourselves mentality, and instead they are embracing the benefits of platform sharing.  The Evernote/Salesforce and Evernote/LinkedIn partnerships are examples.  They expand their user base, and we the users expand the  benefits of our accounts.

Well, I am well rested (sorta?) from our family vacation to Dubai, Singapore, Malaysia, and Japan.  Now it's back to work and back to blogging....

Marketing Automation

As a group we lawyers are growing into the idea of social marketing. LinkedIn, Twitter, Pinterest, blogging are all options that we are dabbling in. Some of us check in everyday.  Others go months at a time with no interactions.  What should we be doing?

The first step is planning.  The second step is implementation. The combined exercise is called marketing automation.  You can do it yourself, or you can let others do it for you.

There are technologies and companies that will do the work for you. Custom software solutions exist, as well as entire companies created to step into your marketing shoes for you. There are writers that will create content, and technologies that will disseminate your marketing across the many platforms that exist.

Wendy Coombes is a marketing consultant with an expertise in technology.  According to Wendy, if you are to successfully employ technology based marketing  in this day and age you must cast a wide net, and you must plan, plan, plan.  When done properly marketing technology enables business to execute campaigns, automate processes, and measure their impact. As for letting someone else do the work for you, there are all kinds of pay-to-play providers ready and willing to go to work for you.

Admittedly some of these solutions may be a bit too grandiose, and too expensive, for the average family law law firm.  There are more modest alternatives.

If you want to do something as simple as creating a blog, you can pay others to do that for you.  Lex Blog will be happy to do ALL of the work for you.  Alternatively there are hundred (nay thousands) of independent writers out there will to provide their services for hire.  Check out BlogMutt, Blur Group, or oDesk.

Then again, you can do it yourself (I do!).  As Wendy advises, make sure you have a plan.

Massive Password Hack

Yet another massive password hack has befallen the social media world.  More than 2,000,000 user passwords were stolen from Facebook, Twitter, Yahoo, LinkedIn and Google.  The huge hack was the product of a virus attacking the sites for the last several months.  More details are provided in a very informative article from CNN.

The obvious response is that you, me, and everyone else should be changing our passwords for all sites.  Have fun!

Is Twitter Cooling Off?

According to a report at the Boy Genius Report, Twitter's phenomenal popularity may be waning.  The BGR report had Twitter adding only one million new subscribers between the March and June quarters in 2013.  Compare that to the three million it added for the same period the year before.  More startling, "the number of U.S. iPhone owners using Twitter has stalled completely between March and August, moving from 27.2% to 27% over a five-month period."  Moving up on the popularity charts:  Instagram and Snapchat.  Please click here to read the original article.

Salesforce.com is a cloud based client relations manager.  They are in the business of helping sales people manage relationships to the end of increasing sales.  Sounds kind of like us lawyers managing our referral networks, huh?

LinkedIn Endorsements

Endorsements on LinkedIn are becoming more popular for all kinds of reasons.  Some people love em, and some people hate em. But what are they, and what do they do for us?

Over at attorneyatwork.com Nancy Myrland gives us the something, something on endorsement.  As Nancy explains "your skills appear in your profile as short words or phrases that describe what you do.  They are then listed on your profile under 'Skills & Expertise" in order, with those skills most often endorsed listed first.  The basic intention is to add credibility and have others speak up on your behalf."

Security Warning For Lawyers On Facebook

At his Law Practice Tips Blog Jim Calloway is reporting yet another way that Facebook can invade your computer world and put you into a troublesome spot.  As reported by Jim "a December update to Facebook provided for automatic synchronization will all photos on your smart phone or iPad with Facebook. And as with all things Facebook, a click in the wrong place can opt you in to the service."

This means that if you have photos on your device that should be private, they could end up being broadcast to your entire Facebook world.  For television reality stars this automatic feature can be a real time saver.  For those of us with a greater need for privacy it could mean real problems.

Social Media Ain't Easy

I am on the website committee for a lawyer organization that I belong to.  The organization is redesigning its website.  The membership of the organization is comprised, for the most part, of lawyers who have been practicing a long time.  Translated that means they are not in their twenties, and social media is very new and bewildering to them.

This web site committee had a meeting recently to review the rough draft, live website.  Prominently displayed up in the right hand corner of the new design were the one-click buttons for Google+ LinkedIn, Facebook, and Twitter.  All the committee members liked how the buttons looked.  However, things got a bit complicated once the question was asked:  "who is going to post the content to the social media pages?"

"Post content?"  "What do you mean?  "I thought stuff just appeared about us when we put the buttons on our website?"  It became very clear in short order that no one on the committee had the foggiest idea what LinkedIn or Facebook or Twitter did.  A dialogue ensued by which it was explained that clicking on the social media buttons allowed the visitors to subscribe to, and/or visit the organization's LinkedIn page, or the organization's Facebook page, or the organization's twitter page. However, no one was aware that unless you had someone writing articles, and posting content to each of those pages there would not be anything for the visitor to see on her visit, and nothing to receive through her subscription.

Another very good question that was asked was:  "why do we need a Google Plus page if we already have a website?

Here is what you need to know my friends:  Goggle+ pages, and LinkedIn accounts, and Facebook pages, and Twitter accounts are nothing more than blank billboards.  If you want your message to get out, the first thing you have to do is write your message.  Then you have to post your message to your social media page.  Then you have to create and post a new message.  And then another one.  And then another.  And so on, and so on.  You want a Facebook page or a Goggle Plus page in addition to a website to get your message out to a broader audience.  Just like you might have a billboard downtown, and one in the suburbs, or a Yellow Pages ad in the Chicago phone book and a second ad in the Joliet phone book.  A website, and a social media sight increase your audience; increase your exposure to search engines, and act as a cross-pollinators for your internet presence.  People viewing your website then click over to your LinkedIn page, and people viewing your LinkedIn page then click over to your website, etc., etc.

Nothing comes easy though and social media is no exception.  The ultimate goal of social media for lawyers is to draw attention to yourself and your law practice, so that people will hire you to be their lawyer.  This happens through people subscribing to your social media site so that your freshly posted content is sent directly to them.  It also happens when the search engines perceive that your social media account has been updated with fresh content so that you move up higher in the search engine rankings.

Take a look at this post.  It is filled with words, and it has a picture.  It took time to write this article.  When I clicked on the publish button in my blog software this article was posted on my blog.  A summary of the article, along with the picture were simultaneously posted to my Google+ page, my Facebook page, my Twitter page, and my LinkedIn page.  The people who are subscribers to this blog automatically received a copy of this article in their email inbox.  Because there are a bunch of words in this post, and a picture, it will draw the attention of Google and Yahoo.  When someone does a Google search of, for example, "social media for lawyers," all of those word are in this article, Google will do the math, and it could then very will post a link to this article in response to that search.  In a few days I will generate a report to see how many people read this article.  It will probably be somewhere in the neighborhood of 150 to 200 people.  200 people might read this article!  That means 200 people will be thinking about me because I am the author of this article.  200 people will read the name John Harding.  200 people will read the name Harding & Associates Family Law.  200 people will have the opportunity to click on the link to my website that appears at the bottom of this story.  Guess what?  About 75 to 100 people actually will click on that link to my website.  There they will read all about me and my family law practice.  That increased traffic on my website is also something that stimulates the search engines and helps my website pop up in Google when some searches for a divorce lawyer!

For the more senior set or readers out there, let me draw an analogy for you.  75 to 100 people will have opened up the Yellow Pages and studied my ad, and thought about hiring me as their family law lawyer.  That's pretty good!  But it took some effort on my part.  I had to come up with an idea to write about, and then I had to spend about 15 minutes doing the writing.  Not a lot of time, but I did have to make the effort.  And that is the key to social media.  You get out of it what you put in to it.

Social Media: What Is It Doing For Me?

Social media can be hard to track as a marketing tool for your practice.  Here is what I know. . .

I am actively engaged with LinkedIn; and am frequently asked to comment about my experiences.  Here is what I can say.

In the three or four years that I have been actively engaging with LinkedIn I have landed two paying clients solely from LinkedIn.  That is clients that found me first, foremost, solely, and directly through my LinkedIn profile. Not overwhelming, but better than nothing.

What I am more impressed with is the traffic that LinkedIn directs to my website.  I am able to review statistics for my website, and at present we are getting one to two viewers per day directly from LinkedIn.  That may seem like a small number, but it really is not a bad return on a free investment.  As a comparison, my Facebook posts do not even average one viewer per week clicking through to our website.

My social media observation?  LinkedIn works modestly.  Facebook, not so much.

Facebook Book

Lots of colleagues ask me for my thoughts on facebook.  I tell them I engage on it, but that I am not overwhelmed with it. Mine is just one opinion, and the fact that facebook has about a billion members would suggest that it has some cache (eve3n if the stock price continues to wither and advertising revenues on the site dwindle).

Allison Shields publishes the Legal Ease Blog, which I enthusiastically read. She and Dennis Kennedy (another legal blogger whom I enthusiastically follow) have published Facebook In One Hour For Lawyers.  Part of the "One Hour" series from the American Bar Association, this book is sure to offer wonderful insights and tips.

WEB_Facebook_OneHour_bigFacebook use continues to rise, and many lawyers are using Facebook in their personal lives to connect with friends and family, but Facebook can be a valuable business building tool, and another way to communicate and engage with colleagues, law firm employees and even clients. One way to do this is by creating a Company Page for your law firm.

What can you do with a Facebook Page for your law firm?

Define Administrator Roles

 In the past, Facebook pages had only one level of administrator, but Facebook has recently created administrator roles, allowing firms to give different levels of permission to different people who have access to the firm's Page. This avoids the problem that arises if only one Page administrator has access to the Page, and that administrator leaves the firm. It also will aid firms who have employees who are interested in contributing to the firm's Facebook presence, but who the firm may not want to have access to all aspects of the 'back end' of the firm's Page.

View insights

It is often difficult to determine whether your social media and other efforts are reaching the audience you would like them to reach, or if your are engaging your audience. Facebook administrators (depending on the Role they have been assigned) have the ability to see 'insights' that show how many people your Page is reaching on a weekly basis, and how many people are "talking about this" or engaging with your content by liking, commenting or sharing it with others.
In addition to these 'big picture' stats, page administrators can see how many people have been reached with an individual post. For each post, you can find out:
Reach: The number of people who have seen your post (within the first 28 days after the post was published)
Engaged Users: The number of people who have actually clicked on your post (within the first 28 days after the post was published)
Talking about this: The number of people who have liked, commented, shared, responded to an event or answered a question you posed in an update (within the first 28 days after the post was published
Virality: The percentage of people who have engaged with the post in any of the ways mentioned in 'talking about this' above, out of the number of people who have seen the post.
Schedule posts
Another relatively new feature of Facebook pages is the ability to schedule posts in advance. This means firms can create a number of posts about newsworthy issues, firm happenings or events all at once, but schedule them to post in the future. Since batching or 'chunking' similar work together is one of the best ways to be productive, this can help firms to ensure that their message is getting seen by their connections and colleagues - or to their employees - without needing to constantly go back to update the Page. This allows the Page administrators to concentrate on engaging with others by spending only a few minutes a day on Facebook, with one weekly time set aside for creating updates.
 Offer Valuable Information to Your Audience
With Facebook's "apps" or "tabs," you can create calls to action. For example, if you offer free information or downloads from your website, such as a personal injury guide, FAQs on divorce in your state, a guide to the court system, etc., you can direct Facebook visitors to your website by creating a custom App. Upload an appropriate image and a link that directs visitors to a landing page you designate.

Use Your Timeline Effectively:

  • Create Milestones, which are to Pages what Life Events are to personal Profiles. Milestones are designated with a flag icon and are the full width of the page (843 x 403 pixels), rather than the smaller size of regular posts (520 pixels wide). A Milestone must include a title, but it can also include other details. Mergers, office moves, and the addition of a new partner are events you might want to include as Milestones.
  • Star stories to expand the post to widescreen and make it more prominent.
  • Pin a post to the top of your Timeline for up to a week—after that, it returns to its chronological place in the Timeline.
  • Backdate posts for special events in the life of your firm that occurred before you started your Page.
